Regulation (EU) 2019/1148 - new Regulation on the marketing and use of precursors for explosives

Since 01 February 2021 Regulation (EU) 2019/1148 has replaced the former Regulation (EU) 98/2013. This results in new obligations and specific documentation requirements for anyone who produces, imports, places on the market, trades in or otherwise dispenses explosives precursors. These new requirements must now be implemented, even within small laboratory areas.

What is new in Regulation (EU) 2019/1148?

It lays down uniform rules for the supply, transfer, possession and use of substances or mixtures that could be misused for the illicit manufacture of explosives. In addition, the aim of the regulation is both to restrict the availability of these substances and mixtures to the general population and to ensure appropriate reporting of suspicious transactions throughout the supply chain.

Who is affected by the new Regulation?

All those who produce, import, place on the market, trade in or otherwise supply precursors for explosives – such as nitric acid, hydrogen peroxide, sulphuric acid, ammonium nitrate (see also Annex I and II of Regulation (EU) 2019/1148) – are required to act.

For users, Regulation (EU) 2019/1148 results, for example, in new obligations and special requirements for documentation. Implementation is also mandatory within small laboratory areas.

According to Article 6 of the Regulation, the acquisition, transfer, possession or use of these precursors must be authorised. In addition, there are new obligations to inform the supply chain (Article 7), to verify on sale (Article 8) and to report suspicious transactions, loss and theft (Article 9).
